This Disclaimer Policy applies to all users of the Services and clarifies the scope, limitations and professional responsibilities associated with using the Services. It forms part of the Terms.
5.1 Platform purpose
Ezyiah assists professional and business users with accounting and business-management tasks, including transaction reconciliation, BAS preparation (G1, 1A and 1B), profit and loss reporting, live bank feeds (via Fiskil), AI Memory, depreciation and fixed assets, quotes, invoices, bills, credit notes, purchase orders, customers, suppliers or vendors, products and services, inventory, Team Members and the Business Dashboard. Some of these features may be released progressively, and this policy applies to each feature once it is made available. The Services are not a substitute for professional judgment or for your own verification of business records and decisions. Business Owners may use the Services directly for their own business, with or without an accountant. Ezyiah's automation supports, and does not replace, review by you and, where your circumstances require it, a qualified professional.
5.2 User responsibility
Final review responsibility rests with you, including accountants, BAS agents, tax agents, bookkeepers and business owners. You must validate, review and approve all Output before submission, issue or use, including bank feed imported transactions, AI Memory-influenced categorisations, depreciation calculations, Business Records, inventory quantities and values, dashboard metrics, AI Insights, Tax Position estimates and the Business Health Score. You are solely responsible for regulatory, legal, tax, commercial and professional compliance. Business Owners remain responsible for their own GST, BAS, income tax, invoicing and record-keeping obligations, whether or not they use an Invited Adviser.
5.3 AI Output
AI-generated Output is an assistance tool only. Output is probabilistic and should always undergo human review. AI Insights and the Business Health Score are indicative business-management aids and are not credit ratings, lending recommendations, solvency opinions, valuations, audit opinions or professional advice. We do not guarantee the accuracy of Output in all circumstances, although the system is designed for reliability and efficiency. AI Insights and Performance Metrics are general information only. They do not take into account your objectives, financial situation or needs and are not financial, tax, legal or financial product advice.
5.4 Lodgement and dealings with the ATO
Ezyiah is not lodgement software and does not lodge, submit, transmit or file tax returns, activity statements, reports or other documents with the Australian Taxation Office (ATO) or any other authority on your behalf. Ezyiah prepares drafts, calculations, reconciliations, reports and dashboard estimates for your review. Any Tax Position displayed in the Business Dashboard, including year-to-date income tax payable or quarter-to-date BAS payable, is an indicative estimate only and is not a lodged amount, ATO assessment, statement of account or substitute for preparation and review of the relevant return or activity statement. You are solely responsible for checking, verifying and approving all Output and for any return, statement or lodgement you make. To the maximum extent permitted by law, Ezyiah is not responsible or liable for any review, audit, investigation, amendment, default assessment, interest charge, penalty, fine or other intervention by the ATO or any other authority, or for any decision, position or lodgement made by you or your advisers. You should obtain advice from a registered tax agent, BAS agent or other qualified professional where appropriate.
5.5 No liability for professional decisions
Subject to the ACL, Ezyiah is not liable for losses, penalties or errors resulting from reliance on Output without proper review. You indemnify Ezyiah against claims arising from non-compliance, incorrect reporting or professional mistakes, on the terms in section 1.21.
5.6 Bank feed disclosure
Live bank feeds are provided through Fiskil and may involve financial institutions or other participants in the applicable banking-data or CDR arrangement. Ezyiah does not connect directly to banks. Bank-feed availability, completeness, timeliness and continuity depend on third-party systems and valid consent or authorisation, and imported data must be reviewed before reliance.
5.6A Business Records, inventory and dashboard information
Quotes, invoices, bills, credit notes, purchase orders, customer and supplier records, product and service records, and inventory information are provided as record-keeping and business-management tools. You are responsible for checking their completeness, accuracy, GST and tax treatment, legal and commercial terms, quantities, pricing, stock movements, statutory wording, document numbering and appropriateness before use. Ezyiah does not warrant that a document generated through the Services will satisfy every tax-invoice, adjustment-note, record-keeping, contractual, evidentiary or industry-specific requirement applicable to your circumstances. Dashboard indicators may be affected by timing, missing or unreconciled transactions, manual adjustments, accounting basis, inventory methodology and other assumptions. Ezyiah does not guarantee collection of receivables, payment of bills, acceptance of quotes, fulfilment of purchase orders, physical stock levels, electronic delivery, legal service, or business outcomes shown or inferred from dashboard information. In particular, if the business issuing a Quote or Invoice is not registered for GST, the document must not include GST or be described as a tax invoice. Ezyiah is not a party to transactions between you and Your Customers or Your Suppliers and, unless a feature expressly states otherwise, does not collect or hold payments on your behalf.
5.6B Business Dashboard, AI Insights and Performance Metrics
The Business Dashboard, AI Insights and Performance Metrics are generated automatically from the data in your account or workspace, including bank feed data, Business Records and categorisation choices. They may be incomplete, out of date or inaccurate, including where transactions are missing, unreconciled or miscategorised. They are provided as general information to help you understand your records and are not a recommendation to take, or not take, any action. You should not rely on them as the sole basis for any tax, financial, lending, investment, staffing or other business decision without checking the underlying records and, where appropriate, obtaining advice from a qualified professional. Nothing in this section limits your rights under the ACL, including the consumer guarantee that services will be supplied with due care and skill.
5.7 Acknowledgement
By using the Services you acknowledge that Ezyiah assists with preparation and business administration only, final responsibility for review, issue, business decisions and submission rests with you, Output requires human review, Tax Position and dashboard indicators are estimates rather than authoritative determinations, AI Insights and Performance Metrics are general information rather than advice, and Ezyiah does not lodge or submit on your behalf.
